“HABITHONISTIM” TERMS & CONDITIONS

The Habithonistim Movement registered non-profit organization no. 580697472 (the “Organization” or the “Movement“) welcomes you to its website operated at: www.idsf.org.il (the “Website” or the “Site“). The Habithonistim Movement was founded with the objective of placing the security of the State of Israel at the top of the national priorities, ensuring the freedom and sovereignty of the Jewish people in their land for generations. The Movement was established by senior security establishment officials who believe that Israel’s security must be based on its ability to defend itself by itself. To achieve this mission, the Movement operates in several key areas: providing professional counsel and tools to policymakers, education and public diplomacy among the public and youth, strategic-security research, and leading public discourse through extensive media activity and presence on social networks (the “Activity” or the “Services“). The Website serves as an online platform to present the Movement’s activities, allow registration for Movement membership or dedicated communities (such as the “Hamesa’ayat” Community), redirect to donation platforms and provide contact information. Furthermore, the Website provides users with a professional database containing position papers, publications, articles and videos.
  1. AGREEMENT TO TERMS:
    1. These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and the Site (“we”, “us” or “our”), concerning your access to and use of the Site as well as any other media form, media channel, mobile website or website related, linked, or otherwise connected thereto. You agree that by accessing the Site, you have read, understood, and agree to be bound by all of these Terms and Conditions (“Terms and Conditions”).
    2. In the event of inconsistency between any terms of this contract and any translation into another language, the Hebrew version will control and prevail on any question of interpretation or otherwise.
    3. We reserve the right, in our sole discretion, to make changes or modifications to these Terms and Conditions at any time and for any reason. We will alert you about any changes by updating the “Last updated” date of these Terms and Conditions and you waive any right to receive specific notice of each such change.
    4. Browsing the Website and using its content is permitted for all ages. However, joining as a Movement member or completing forms by a user under the age of 18 shall be deemed as actions performed with the knowledge and explicit consent of their parents or legal guardian. Performing financial transactions (such as making a donation or paying membership fees for the ‘Hamesa’ayat’ Community) is restricted to legally competent individuals aged 18 and older, or through the explicit authorization of the payment method owner.
  2. INTELLECTUAL PROPERTY RIGHTS:
    1. Unless otherwise indicated, the Site is our proprietary property and all source code, databases, functionality, software, application, designs, audio, video, text, photographs, and graphics on the Site (collectively, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by us or licensed to us.
    2. The Content and the Marks are provided on the Site “AS IS” for your information and personal use only. Except as expressly provided in these Terms and Conditions, no part of the Site and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.
    3. Provided that you are eligible to use the Site, you are granted a limited license to access and use the Site and to download or print a copy of any portion of the Content to which you have properly gained access solely for your personal, non-commercial use. We reserve all rights not expressly granted to you in and to the Site, Content and the Marks.
  3. USER REPRESENTATIONS:
    1. By using the Site, you represent and warrant that: (1) Each and every use of the Site is at your own risk and responsibility; (2) all registration information you submit will be true, accurate, current, and complete; (3) you will maintain the accuracy of such information and promptly update such registration information as necessary; (4) you have the legal capacity and you agree to comply with these Terms and Conditions; (5) you will not access the Site through automated or non-human means, whether through a bot, script or otherwise; (6) you will not use the Site for any illegal or unauthorized purpose; and (7) your use of the Site will not violate any applicable law or regulation.
    2. We have the right to refuse any and all current or future use of the Site. Without limiting the generality of the foregoing, if you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to block your access and refuse any and all current or future use of the Site (or any portion thereof).
  4. JOINING AND MEMBERSHIP IN THE MOVMENT:
    1. The Website allows users to join as members of the Movement. Joining the Movement entails completing an online registration form.
    2. Joining as a regular Movement member (which is not within the framework of paid dedicated communities) is free of charge.
    3. As part of the registration, the user will be required to provide personal details (such as name, phone number and email) and may provide, at their discretion, additional details. The user undertakes to provide true and accurate details. It is clarified that the rules regarding the retention and use of information, as well as the rules regarding the sending of direct mailing and promotional material to the the Movement members, are governed and detailed extensively in the Website’s Privacy Policy.
    4. A Movement member may request to cancel their membership in the Movement at any time by contacting the Organization. The procedure for removal from the distribution and mailing lists is detailed in the Privacy Policy.
    5. The Organization reserves the right to approve, reject or cancel a person’s membership in the Movement, at any time and at its sole discretion, without the need to provide any reason.
  5. MAKING A DONATION TO THE ORGANIZATION:
    1. Donations can be made through the Website conveniently, easily and securely, using a credit card, a bank transfer or any other payment method presented on the Website at the time of the donation. It is hereby clarified that some of the donation systems are managed and operated by external crowdfunding platforms. In such cases, the donation is also subject to the terms of use and privacy policies of those platforms.
    2. When making a donation, the donor will be required to provide personal details, such as full name, phone number, email address and other details at the Website’s discretion. The donor is responsible for providing true, accurate, current and complete information. The Website reserves the right to verify the details entered after the donation is made.
    3. The donor is aware and agrees that, as part of the Organization’s policy, upon making a donation, they will be joined as a member of the Movement. The donor may request their removal from the Movement membership list at any time by contacting the Organization in writing, as detailed in the Privacy Policy.
    4. Donations will be made using a credit card belonging to the donor or any other means presented on the donation page. Upon confirmation of the donation transfer, the Organization (or its external partner) will issue a donation receipt to the donor in accordance with the law. It is clarified that the Organization is an approved public institution for donation purposes, and donations to it are recognized for tax credit purposes in Israel under Article 46 of the Income Tax Ordinance (and are tax-exempt abroad through external partners, where applicable).
    5. Making donations on the Website is subject to additional terms and conditions that will be detailed on the Website.
    6. The donor confirms and agrees that: (1) they are aware that the donation is made of their own free will and they will not receive anything in return for the donation; (2) the Organization may use the donation funds at its sole discretion, in accordance with the Organization’s goals detailed on the Website.
    7. Cancellation of a donation will be possible in accordance with the provisions of the Israeli Consumer Protection Law, 5741-1981. A request to cancel a donation shall be addressed in writing to the Organization or to the external platform through which it was made, accompanied by the original donation receipt.
    8. In addition to the provisions of these Terms, the provisions of the clearing company’s or other payment method’s terms and conditions shall also apply. Notwithstanding the above, the Website reserves the right to establish other payment arrangements, all at its sole discretion.
  6. “HAMESA’AYAT” Community:
    1. The Movement operates a dedicated community named the “Hamesa’ayat Community” (the “Community”). The purpose of the Community is to provide its members with access to expanded information, as well as high-quality, professional, and exclusive content that is not shared with other Movement members or the general public.
    2. Membership in the Community grants benefits such as: weekly online meetings, access to the Movement’s magazine, participation in closed discussion groups, access to a content library, a member card providing benefits, and more. The Movement is entitled to change the benefit package from time to time.
    3. Membership in the Community involves the payment of monthly or annual membership fees, in accordance with the rates specified on the joining page. Payment shall be made via credit card through a secure clearing system.
    4. Membership fees for the monthly plan are collected via a recurring monthly charge. The user authorizes the automatic charge each month until the cancellation of the membership by them.
    5. Membership fees for the annual plan are paid in advance in a single payment. It is clarified that membership in the Community under this plan is limited to one year only from the date of payment and does not renew automatically (unless the user actively chooses to renew it).
    6. participant may cancel their membership at any time by sending an email to the Movement’s address. The cancellation will take effect within two business days.
    7. A request received less than 48 hours before the monthly billing date will take effect from the next cycle.
    8. The user will continue to enjoy the Community benefits until the end of the last paid period collected.
    9. It is clarified that benefits associated with the member card (such as entry to the annual conference) are contingent upon the membership in the Community being in effect at the time of the event or the realization of the benefit.
    10. The Movement reserves the right to update, change, or replace the plans, rates, and the benefit or bonus package from time to time and at its sole discretion.
  7. REGISTRATION FOR TOURS AND FIELD ACTIVITIES:
    1. The Website enables, periodically, registration for participation in security tours, heritage tours, observations and various field activities organized by the Movement (the “Tours”).
    2. Registration for Tours is open to the general public (unless otherwise specified) and is conducted via an online registration form and credit card payment on the Website. Registration is contingent upon advance payment.
    3. Insofar as the Tour includes organized transportation on behalf of the Movement, participants must arrive independently at the pre-defined pickup points. Furthermore, unless explicitly stated otherwise on the Tour page, participants are responsible for providing their own food, water and personal equipment suitable for field and weather conditions.
    4. Participation in the Tours is at the participant’s sole responsibility. The Tours are subject to and contingent upon the instructions of the IDF and the Israel Police and where necessary, will be accompanied by an armed escort. Participants must obey the instructions of the guides, armed escorts and security forces at all times. Arrival at the Tour constitutes a health declaration by the participants that they are fit for the activity.
    5. It is hereby clarified that due to the nature of the Tours and the security situation, last-minute changes may occur in the Tour route, the identity of the lecturers/guides or the landmarks (including replacement with an alternative community or site). Such changes shall not be considered a breach of the registration terms and shall not entitle the participant to a refund.
    6. The Movement reserves the right to cancel a Tour due to various constraints (weather, low registration, security directives, etc.). In the event of a full cancellation by the Movement, the participant will receive a full refund.
    7. In general, the cancellation policy is subject to the provisions of the Consumer Protection Law. However, it is clarified that if a different cancellation policy was published on the specific registration page for a Tour (such as the possibility to cancel up to 48 hours in advance for a fixed cancellation fee), the specific policy published on the Tour page shall prevail over the provisions of these Terms. A request to cancel registration shall be made in writing via the contact details appearing on the Website.
  8. PROHIBITED ACTIVITIES:
    1. You may not access or use the Site for any purpose other than that for which we make the Site available. The Site may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us.
    2. As a user of the Site, you agree not to:
      1. systematically retrieve data or other content from the Site to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us;
      2. make any use of the Site’s designs;
      3. steal, copy and/or make any unauthorized use of the content, professional articles, or unique methodology presented on the Website;
      4. make any unauthorized use of the Site, including collecting email addresses of users by electronic or other means for the purpose of sending unsolicited email by automated means or under false pretenses;
      5. circumvent, disable, or otherwise interfere with security-related features of the Site, including features that prevent or restrict the use or copying of any Content or enforce limitations on the use of the Site and/or the Content contained therein;
      6. trick, defraud, or mislead us and other users;
      7. make improper use of our support services or submit false reports of abuse or misconduct;
      8. engage in any automated use of the system, such as using scripts to send comments or messages, or using any data mining, robots, or similar data gathering and extraction tools;
      9. attempt to impersonate another person;
      10. use any information obtained from the Site in order to harass, abuse, or harm another person;
      11. use the Site as part of any effort to compete with us;
      12. decipher, decompile, disassemble, or reverse engineer any of the software comprising or in any way making up a part of the Site;
      13. harass, annoy, intimidate, or threaten any of our employees or agents engaged in providing any portion of the Site to you;
      14. delete the copyright or other proprietary rights notice from any Content;
      15. copy or adapt the Site’s software, including but not limited to Flash, PHP, HTML, JavaScript, or other code;
      16. upload or transmit (or attempt to upload or to transmit) viruses, trojan horses, or other material, including use of spamming, that interferes with the enjoyment of the Site;
      17. disparage, tarnish, or otherwise harm, in our opinion, us and/or the Site;
      18. use the Site in a manner inconsistent with any applicable laws or regulations.
    3. Any use of the Site in violation of the foregoing violates these Terms and Conditions and may result in, among other things, termination or suspension of your rights to use the Site.
  9. THIRD-PARTY CONTENT:
    1. The Site may contain (or you may be sent via the Site) links to other Sites (“Third-Party Sites”) as well as articles, photographs, text, graphics, pictures, designs, music, sound, video, information, applications, software, and other content or items belonging to or originating from third parties (“Third-Party Content”). Such Third-Party Sites and Third-Party Content are not investigated, monitored, or checked for accuracy, appropriateness, or completeness by us, and we are not responsible for any Third-Party Sites accessed through the Site or any Third-Party Content posted on, available through, or installed from the Site, including the content, accuracy, offensiveness, opinions, reliability, privacy practices, or other policies of or contained in the Third-Party Sites or the Third-Party Content. Inclusion of, linking to, or permitting the use or installation of any Third-Party Sites or any Third-Party Content does not imply approval or endorsement thereof by us.
    2. Any purchases you make through Third-Party Sites will be through other sites and from other companies, and we take no responsibility whatsoever in relation to such purchases which are exclusively between you and the applicable third party.
  10. SITE MANAGEMENT:
    1. We reserve the right, but not the obligation, to: (1) monitor the Site for violations of these Terms and Conditions; (2) take appropriate legal action against anyone who, in our sole discretion, violates the law or these Terms and Conditions, including without limitation, reporting such user to law enforcement authorities; (3) in our sole discretion and without limitation, refuse, restrict access to, limit the availability of, or disable (to the extent technologically feasible) any of your content or activities on the Site or any portion thereof; and (4) otherwise manage the Site in a manner designed to protect our rights and property and to facilitate the proper functioning of the Site.
  11. COPYRIGHT INFRINGEMENTS:
    1. We respect the intellectual property rights of others. If you believe that any material available on or through the Site infringes upon any copyright you own or control, please immediately notify us using the contact information provided below.
  12. TERM AND TERMINATION:
    1. These Terms and Conditions shall remain in full force and effect while you use the Site. Without limiting any other provision of these Terms and Conditions, we reserve the right to, in our sole discretion and without notice or liability, deny access to and use of the Site (including blocking certain IP addresses), to any person for any reason or for no reason, including without limitation for breach of any representation, warranty, or covenant contained in these Terms and Conditions or of any applicable law or regulation. We may terminate your use or participation in the Site and any content or information that you posted at any time, without warning, in our sole discretion.
  13. MODIFICATIONS AND INTERRUPTIONS:
    1. We reserve the right to change, modify, or remove the contents of the Site at any time or for any reason at our sole discretion without notice. However, we have no obligation to update any information on our Site.
    2. We also reserve the right to modify or discontinue all or part of the Site without notice at any time. We will not be liable to you or any third party for any modification, suspension, or discontinuance of the Site.
    3. We cannot guarantee the Site will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance related to the Site, resulting in interruptions, delays, or errors.
  14. DISCLAIMER AND LIABILITY:
    1. THE ACTIVITIES AND SERVICES ARE PRESENTED ON THE WEBSITE AS THEY ARE OFFERED AT THAT TIME. THE WEBSITE IS NOT COMMITTED TO PROVIDING ANY SPECIFIC VARIETY OF SERVICES AND MAY CHANGE, REPLACE, ADD OR REMOVE ANY CONTENT, ACTIVITY OR SERVICE DISPLAYED ON IT, AT ANY TIME AND AT ITS SOLE DISCRETION, WITHOUT PRIOR NOTICE.

    6. The Website offers, in part, information, articles and recommendations regarding hiking trails, heritage sites, and observation points. It is hereby clarified that this information is provided as a general recommendation only. The Movement bears no responsibility for the nature of the trails, their safety, difficulty level, weather conditions, accessibility or any injury or property damage caused to a user who chooses to hike these trails independently. It is the hikers’ sole responsibility to verify field conditions and comply with the safety and security directives of the IDF, Israel Police, and authorized authorities before departing on any trail.
    7. Information and presentations originating from the Site’s business partners or third parties are the sole responsibility of said third parties. The Site does not guarantee the accuracy of such information and shall have no liability in connection therewith.
    8. The Website allows for the submission of requests to book lectures, seminars or dedicated group tours via online forms. It is clarified that submitting a form does not constitute an approval, commitment or binding contract on behalf of the Movement to conduct the Activity. The actual execution of any lecture or Activity is contingent upon advance coordination, final approval from the Movement, and, if necessary, the signing of a separate engagement agreement, all at the Movement’s sole discretion.
    9. Insofar as the Movement offers registration for seminars or weekends that include lodging and catering services, it is clarified that the Movement serves as a content organizer only. Lodging and catering services are provided by external vendors (hotels/hostels), and the Movement shall not be liable for any damage, dissatisfaction, or malfunction related to these services.
  15. GOVERNING LAW:
    1. These Terms and Conditions and your use of the Site are governed by and construed in accordance with the laws of the State of Israel applicable to agreements made and to be entirely performed within the State of Israel, without regard to its conflict of law principles.
    2. Any legal action of whatever nature brought by either you or us (collectively, the “Parties” and individually, a “Party”) shall be commenced or prosecuted to the competent courts in the Central District of Israel, and the Parties hereby consent to, and waive all defenses of lack of personal jurisdiction and forum non conveniens.
  16. CORRECTIONS:
    1. There may be information on the Site that contains typographical errors, inaccuracies, or omissions that may relate to the Site, including descriptions, availability, and various other information. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update the information on the Site at any time, without prior notice.
  17. MISCELLANEOUS:
    1. These Terms and Conditions and any policies or operating rules posted by us on the Site constitute the entire agreement and understanding between you and us. Our failure to exercise or enforce any right or provision of these Terms and Conditions shall not operate as a waiver of such right or provision. We may assign any or all of our rights and obligations to others at any time.
    2. If any of these Terms and Conditions are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term will to that extent be severed from the remaining terms which will continue to be valid to the fullest extent permitted by law.
